Choosing between a national OSIM trademark and an EU trademark at EUIPO depends on where you actually use the brand and on your expansion plans.

The short answer: you choose between OSIM and EUIPO based on the territory where you actually use the brand. A national OSIM trademark protects Romania; an EU trademark at EUIPO covers all member states through a single registration, including Romania.

OSIM: national protection

Registering with OSIM suits a business and brand concentrated in Romania. The procedure is national and protection is limited to Romanian territory. For a local company with no immediate expansion plans, a national mark can be sufficient and more economical.

EUIPO: one mark for the whole Union

The EU trademark, registered at EUIPO, grants protection across all member states through a single filing. It is the logical choice for companies that sell, or intend to sell, in several European countries. An EU trademark also has effect in Romania, with no separate national registration.

Note, however, that an EU trademark must be put to genuine use in the Union. Use limited to a single territory can create problems if the mark is challenged for non-use.

How to choose between them

The decision comes down to a few practical questions:

  • Where do you actually use the brand today, and where will you sell in the coming years?
  • How likely is expansion into other member states?
  • Are there already similar marks in the territories that matter?
  • How does the mark connect to contracts, licences and the group structure?

A clearance check before filing reduces the risk of refusal or later conflict. The sign, the classes and the owner should be chosen together, not separately.
