Trademarks

A trademark should be protected before the brand becomes exposed.

Trademark registration is not just a filing. The sign, classes, territory, owner, actual use and contractual structure all matter for future enforcement, licensing and expansion.

Before filing

We review obvious risks through a clearance search, settle the relevant classes of goods and services, the right owner and whether protection should be Romanian, EU or international. A check done before filing reduces the risk of refusal or later conflict.

OSIM, EUIPO or international

A national OSIM mark protects Romania; an EU trademark at EUIPO covers every member state through a single registration, including Romania. For markets outside the EU the international system is considered. The chosen territory should match how the brand is actually used.

Portfolios and transactions

Trademarks should be ready for licensing, assignment, audit, investment, sale or market expansion. A tidy portfolio, with the correct owner and documented use, has real value in due diligence.

Use and maintenance

A trademark must be put to genuine use to stay protected; non-use can expose it to revocation. We therefore connect the filing strategy with how the mark is used in contracts, on products and in communication.

Multijurisdictional work

For international portfolios, we coordinate the Romanian component and work with local collaborators where the project requires it, keeping a single view of territories, classes and owners.

FAQ

When should a trademark be filed?

Ideally before public launch, significant brand investment or negotiations that expose the commercial name.

OSIM or EUIPO?

It depends on the target market. Romania-only protection may point to OSIM; EU protection usually requires EUIPO analysis, and an EU mark also covers Romania through a single registration.

What should I check before filing a trademark?

The availability of the sign through a clearance search, the right classes, the correct owner and whether similar marks already exist in the territories that matter.

Can I lose a trademark if I do not use it?

Yes. A mark that is not put to genuine use can be exposed to a revocation action for non-use, so real use should be planned and documented.
